Terms and Conditions – NexusPCs

All purchases made through NexusPCs at nexuspcs.com.au are governed by the Terms and Conditions set out below. These terms outline your legal rights and obligations, including applicable exclusions and limitations. By placing an order with NexusPCs (“nexuspcs.com.au”), you (“Customer” or “Consumer”) agree to be bound by these Terms and Conditions.

You and NexusPCs agree that these Terms and Conditions constitute the complete and exclusive agreement governing all sales transactions between NexusPCs and the Customer.

Conditions of Use

This Standard Terms and Conditions Agreement (“Agreement”) applies to every order, purchase, receipt, delivery, and use of any product supplied by NexusPCs, including its related entities and affiliates (collectively referred to as “NexusPCs”, “we”, “us”, or “our”).

By accepting delivery of products described on your invoice, you agree to be bound by these Terms and Conditions. Any attempt to vary, supplement, or amend these Terms, or to submit an order subject to alternative terms, will be void unless expressly agreed in writing and signed by both you and NexusPCs.

We reserve the right to amend these Terms and Conditions at any time without prior notice, at our sole discretion.

Definitions

“We”, “us”, “our” refers to NexusPCs (nexuspcs.com.au).
“You” or “your” refers to the individual or entity named on the invoice.

Payment Terms

Orders; Interest

All advertised prices are listed in Australian Dollars (AUD). Unless stated otherwise, prices exclude shipping, handling, and any applicable taxes imposed by the relevant governing authority in your jurisdiction.

Payment terms are determined at our sole discretion. Unless otherwise agreed in writing, full payment must be received before NexusPCs accepts and processes your order. We may issue separate invoices for portions of an order.

Interest may be charged on overdue amounts at the highest rate permitted by law.

Duties and Taxes

Unless otherwise stated on your invoice, you are responsible for all duties and taxes associated with your order.

Prices displayed on nexuspcs.com.au include 10% Australian GST where applicable. If your order is shipped outside Australia, you are responsible for all duties, GST, customs charges, and associated import/export fees.

Shipping and Title

NexusPCs will arrange shipping of purchased products to the address nominated by you.

Ownership (title) of the product transfers to you when we deliver the goods to the carrier. Risk of loss or damage transfers to you once the goods are delivered to your nominated address.

Title to any included software remains with the software licensor. Use of software is governed by the applicable license agreement.

You must notify NexusPCs within five (5) days of receiving your order if any items are missing or damaged.

Order Cancellation

Once an order is placed, processing begins immediately. As all PCs are customisable and/or made-to-order, this includes ordering components, allocating staffing resources, and undertaking administrative work, all of which incur costs.

Accordingly, cancellations cannot receive a full refund without cost.

Cancellation fees may apply to cover reasonable costs already incurred including component ordering, labour, and administrative processing.

Cancellation options are:

  1. Order cancelled with a refund issued minus a 25% restocking fee; or
  2. Order cancelled with a credit issued for the full purchase amount in the form of a coupon code for use on nexuspcs.com.au (redeemable in full or across multiple purchases).

This cancellation policy is firm and non-negotiable. Please review carefully before completing your purchase.

Returns

We do not provide refunds or exchanges for:

  • Change of mind
  • Incorrect product selection
  • Faults disclosed prior to purchase
  • Damage caused by alterations not performed by NexusPCs
  • Damage resulting from misuse or non-recommended use
  • Damage outside our control
  • Claims without proof of purchase

To submit a Refund, Return, Warranty, or Consumer Guarantee claim, please email sales@nexuspc.com.au

If a product is assessed as No Fault Found, a service fee of up to $50 plus shipping may apply. Inspection or rejection fees charged by authorised service centres may also apply. If goods are found to comply with Australian Consumer Law, you may be required to pay return shipping costs.

Eligibility Requirements

To qualify for a claim, you must:

  • Review and comply with the manufacturer’s warranty (if applicable)
  • Report the fault and return the goods to NexusPCs
  • Provide proof of purchase
  • Stop using the faulty item
  • Exercise reasonable care while the item is in your possession
  • Ensure the fault was not caused by misuse
  • Retain the product (it must not be lost or disposed of)
  • Report faults promptly to avoid reduction in value

We reserve the right to reject claims where these conditions are not met.

Restocking (Courtesy Returns)

In limited cases, we may offer a conditional courtesy return for incorrectly purchased products where:

  • We are notified within 5 days of delivery
  • The product is unopened and in pristine, resellable condition with all accessories and packaging
  • A minimum 20% restocking fee is accepted

We reserve the right to inspect and reject any return that does not meet these conditions. Approved returns remain at our discretion.

Handling Times

All PCs are subject to estimated handling times (business days, Monday–Friday). These are estimates only and are not guaranteed unless expressly stated on the product listing.

No financial or other compensation will be provided if shipping exceeds estimated handling times.

Returning Goods to NexusPCs

We are not responsible for goods lost or damaged in transit when returned by the customer. If goods are damaged during return shipping, warranty may be void.

Shipping costs will be covered by NexusPCs for PCs that arrive damaged in transit or are Dead on Arrival (DOA). DOA claims must be made within 7 business days of receipt.

All warranty and refund claims are processed in the order received.

Warranty – NexusPCs Systems

All NexusPCs systems include a 12 Month Return-to-Base Warranty from the date of purchase.

  • Faulty PCs may be returned for repair (shipping may apply).
  • Technicians may take up to 14 business days to complete return-to-base warranty claims.
  • Third-party components carry manufacturer warranties.

Where required, warranty claims may need to be processed directly with the manufacturer.

Disclaimer of Warranties

Except as expressly stated in these Terms or in an applicable warranty statement, NexusPCs provides no additional express or implied warranties. Software and services are provided without warranty unless specified in a license agreement.

International Customers

The above warranty applies to NexusPCs-branded products shipped internationally; however, international customers are responsible for all freight, customs duties, GST, and related charges, including return shipping of defective parts.

Software

All software is supplied subject to its accompanying license agreement. By opening or using the software, you agree to the license terms. NexusPCs does not warrant software beyond the manufacturer’s license terms.

Manufacturer’s Warranty

NexusPCs is not a manufacturer or authorised service centre. Customers are encouraged to contact the manufacturer’s technical support before lodging a claim.

Due to privacy legislation, we cannot submit warranty claims on your behalf without proper authority.

If instructed by a manufacturer to return goods to us, please email sales@nexuspc.com.au to lodge a warranty request.

Physical Alteration by End User

Unauthorised physical modifications to a PC may void warranty. This includes (but is not limited to):

  • Adding/removing components
  • Changing cable configurations
  • Modifying BIOS/system settings
  • Removing and reinstalling components

If alterations are deemed to have caused or contributed to a fault, we reserve the right to deny warranty or request payment for repairs.

Unauthorised Repairs

There are no authorised third-party repair centres in Australia for NexusPCs warranty repairs.

Customers must not have PCs repaired by unauthorised providers unless approved in writing. We will not reimburse costs incurred through unauthorised repairs.

Unassembled Orders

We offer PCs as either:

  • Fully assembled, stress-tested systems; or
  • Individual components (Unassembled Shipping).

We may withdraw Unassembled Shipping at any time. Original retail packaging is not guaranteed.

Our assembled system warranty does not apply to Unassembled Orders. Manufacturer warranties apply to individual components. Customers are responsible for initiating manufacturer warranty claims unless directed otherwise.

Unassembled orders are not prioritised.

NexusPCs Products

We continuously update and revise our products and services. We may discontinue or revise products without notice.

Photos are displayed on the product as a showcase, certain part brands and general part sizes showcased on the photos may differ to the final product shipped to you due to customisability, however the specifications will always be the same as what you order.

Products shipped will meet functional and performance standards but may differ slightly from published specifications. Components may be new or equivalent-to-new, and spare parts may be new or reconditioned.

Software & Peripherals

Third-party peripherals and software are covered by their respective manufacturers’ warranties. NexusPCs-branded peripherals follow the warranty terms outlined above.

Limitation of Liability

To the fullest extent permitted by law, NexusPCs will not be liable for:

  • Loss of profits
  • Loss of business
  • Lost or corrupted data
  • Consequential, indirect, special, or punitive damages

Our liability is limited to the total amount paid for the relevant product or service.

Not for Resale

Products are sold for personal use only and not for resale. Warranty is non-transferable.

Intellectual Property & Domain Use

You must not register or use any domain name containing “NexusPCs” or any confusingly similar name.

Product Information Policies

Price Protection

Prices are subject to change without notice. By purchasing, you agree to the listed price at checkout.

We reserve the right to correct pricing or specification errors arising from technical or human mistakes.

Product Images

Images are for reference only and may differ from the actual product. Typographical errors are subject to correction.

Product Descriptions

Specifications and descriptions may contain inaccuracies. We will correct any identified errors promptly.

Product Availability

Stock availability may change without notice. Items listed as available may sell out and become backordered.

Shopping Networks

We are not responsible for inaccuracies on third-party shopping platforms. Please contact sales@nexuspc.com.au for clarification prior to purchase. We do not refund or exchange for incorrect purchases.

Governing Law

These Terms are governed by the laws of Australia and applicable provisions of the Australian Consumer Law.

Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions remain in effect.

Waiver

Failure to enforce any provision does not constitute a waiver of future enforcement. Any waiver must be in writing.

Limitation of Liability Under Competition and Consumer Act

Subject to the Competition and Consumer Act 2010 (Cth):

For major failures, liability is limited to:

  • Replacement of goods
  • Payment equivalent to purchase cost
  • Payment for reduction in value

For minor failures, liability is limited to:

  • Repair
  • Replacement
  • Payment of replacement cost

All other representations, conditions, guarantees, and warranties not expressly stated are excluded to the extent permitted by law.

Competition and Consumer Act

Nothing in these Terms excludes or limits rights under the Competition and Consumer Act 2010 (Cth) or other laws that cannot be lawfully excluded.
